QYou obviously shoot more images than are included I understand you shoot far more pictures during the event than we ?

ABasically, the answer is "yes," you are permitted to use the digital images for personal non-commercial purposes.

To begin, when we say that you may use the files for personal purposes as opposed to commercial purposes, what we're saying is that, as a general rule of thumb, if you're using our work product and it is either directly or indirectly making you money, no matter how little or how much, that is a big no-no and is not permitted. Let me give you some examples of what is meant by the word "personal" and "commercial."

Examples of "commercial purposes": making some cool prints of our images and then selling them at an art show or craft show, using one of our images as a background for your web site where you sell widgets, slapping one of our pictures in your company's weekly newsletter to prospective clients.

Alternatively, the following are just fine and considered "personal purposes": taking the CD of images and uploading them to mpix.com or adoramapix.com to make some additional prints for your family and friends, attaching a picture to an e-mail you send out to your family, or perhaps setting all the images to music in a personally crafted DVD slide show that you send to individuals unable to make it to your event.

In short, just use the images for your own personal fun and enjoyment and everything will be A-OK. Keep in mind though, some of our lowest level packages may have restrictions as to such personal usage so please take a look at our pricing pages (wedding packages as well as our engagement packages) for more details where it talks about "reproduction rights."

 

QYour answer above was slightly confusing; would you answer it another way just so I may better understand what you're saying when it comes to "personal reproduction & usage rights" to the digital images?

AWithout getting into the legal details of it, the take-away message is that you are permitted to do pretty much whatever the heck you want with the images (e.g., print, copy & e-mail to friends/family, publish them on your blog, etc). Basically, if you are using the images for personal purposes, then go right ahead!

However, one major exception to this blanket permission is that you may not use them for any commercial purpose whatsoever (e.g., using them in your advertising, selling them, etc). In short, if you will be earning money from the use of the images (either in whole or in part), assume that such usage is a big fat no-no.

As far as who owns the copyright, U.S. Copyright Law clearly states that Amie Morgan Photography, the photographer and entity that generated the work, holds the copyright. Of course, as described above, I may license or otherwise authorize others to use the photographic work product (which is exactly what I described above)..

 

QI want to re-work the digital file on my own and make a new variation on the image, is this OK?

AYes and no. Yes, you may do so but only on the condition that the new image you produce (the derivative work) reasonably does not damage or otherwise interfere with the reputation or goodwill of our business. In short, you are not permitted to take one of our pieces and just trash it while still attributing the work to our business. 

I mean, just think about it, if some other person were to see it and think that Amie Morgan Photography is responsible for a photograph that by no means conforms to our style and quality standards, they very well may be "scared away" from doing business with us.  Such damage to our reputation and goodwill is simply unacceptable.

As the saying published in Google's official Code of Conduct goes, "don't be evil." Meaning, "do the right thing . . . act honorable, and treat each other with respect." So, let's take their advice and do just that when manipulating images we worked long and hard on to generate for you.

 

QWho exactly holds the copyright to the images? Is it me, the client, or you, the photographer?

AAs the photographer who originally generated the image in our camera, as well as the entity who did all the post-production editing work to generate the final work product, in harmony with U.S. Copyright Law, we (Amie Morgan Photography) holds the actual copyright to both the digital content as well as any printed proofs and / or enlargements.

Don't worry, it's not as gloomy as it sounds, given that we basically grant you (depending on the package ordered) a tremendously generous license to use the images for personal purposes.

As described above, you can more or less use the images for whatever you feel like as long as it is a "personal" purpose and is not a "commercial" one.
